Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your engagement with Elevator Innovation Studios LLC ("Elevator" "we," "us," or "our"). By accessing our services, you agree to these terms in full.

2. Services

Our services include but are not limited to:

• Industrial design

• Design strategy consulting

• Brand identity design

• User interface design and development

• User experience design

• Innovation Strategy

• Engineering

• Animation

Estimates of costs and time required for a project are based on best judgments and the assumption that there will be no delays caused by the client or their integral suppliers or vendors or by circumstances beyond Elevator’s control. If the client makes any changes in the project that cause an increase in the proposed costs or scheduled project duration presented herein, Elevator will halt work on the project, notify you of the impact of these changes and will request your approval prior to project continuation. Elevator reserves the right to revise the estimated cost and/or schedule based on any new project parameters.  Time estimates also assume timely payment of invoices due per request. Delays in payment may result in cessation of work and the addition of time to the agreed upon schedule.

The client shall not unreasonably withhold acceptance of, or payment for, the project. If, prior to completion of the project, the client observes any non-conformance with the design plan or schedule, Elevator must be promptly notified, allowing for necessary corrections. Rejection of the completed project or cancellation during its execution will result in forfeiture of deposit and the possible billing for all additional labor or expenses to date. All elements of the project must then be returned to the designer. Any usage by the client of those design elements will result in appropriate legal action. Client shall bear all costs, expenses, and reasonable attorney's fees in any action brought to recover payment under this contract or in which Elevator may become a party by reason of this contract. Further, it is agreed that you will indemnify Elevator and save it harmless from any damages, costs or losses that may be suffered as a result of any claim arising out of the services performed or the materials prepared by me in connection with this project.

Either your endorsement of this proposal in the space provided, or receipt of a purchase order for this proposal will signify acceptance of all of the terms presented in this proposal and will form an agreement. Elevator is authorized to execute the project as outlined in this agreement.  Payment will be made as proposed as previously described.
